Das EMLE-Programm ist ein forschungsorientiertes Masterprogramm. Das Masterniveau findet sowohl Ausdruck in der konstitutiven Anwendung einer bestimmten Methode (ökonomische Analyse) auf einen bestimmten Gegenstand (das Recht), als auch darin, dass diese ökonomische Analyse fast durchgängig rechtsvergleichend erfolgt. Der funktionale Ansatz der ökonomischen Analyse des Rechts kann durch die Rechtsvergleichung besonders eindrücklich gezeigt werden, weil er erlaubt, unterschiedliche Lösungen für im Kern identische Probleme miteinander zu vergleichen.

Diese Vorgehensweise stellt hohe Ansprüche an die Studierenden, da sie drei verschiedene Elemente (ökonomische Analyse, juristischer Inhalt, Rechtsvergleichung) miteinander kombinieren müssen. In den Veranstaltungen wird stets die neueste Literatur genutzt. Einige Vorlesungen sind so nah an der aktuellen Forschung, dass Lehrbücher zu den behandelten Themen noch nicht verfügbar sind (so z.B. für die Veranstaltung "Public Law and Economics II", welche sich mit den ökonomischen Konsequenzen von Verfassungsregeln beschäftigt).

General Information

The EMLE-programme is a research-oriented master programme. The master level is documented by both the use of a constitutive method (economic analysis) on a particular subject (law) and the fact that this economic analysis is based on a continuous legal comparison. The functional approach of the economic analysis of law is well suited to compare different solutions to problems, which are in their essence identical.

This approach demands much from the students, because they have three different elements (economic analysis, law and comparative law) combined with each other. The literature used in the lectures is always up to date. Some lectures are based so close to the current research that textbooks are not yet available (e.g. “Public Law and Economics II”, which deals with the economic consequences of employed constitutional regulations).
